1. BOOKING YOUR TOUR

1.1 A booking form shall be sent to the person who expresses interest in booking any of our trips. By signing the booking form, you (herein referred to as “the Client”) enter into contract with Impact Adventure Travel Company (herein referred to as “the Operator”). The Client accepts that they have read and understood all the booking conditions and agree to abide by them.

1.2 A safari booking is confirmed when the Operator issues written confirmation of the same.

2. PAYMENT

2.1 Confirmation of all bookings is subject to receipt of a duly signed booking form and a deposit of 30% of the total cost of the tour. Full payment is required if booking within 42 days before departure. For group departures, one member shall sign the booking form on behalf of the other members.

2.2 The full balance of payments is due not later than 42 days prior to the departure of the trip, unless agreed otherwise. If the balance is not received in time the Operator reserves the right to treat your booking as cancelled.

2.3 Should external factors such as government taxes, exchange rates and conservancy fees, that are beyond the Operator’s control adversely affect the cost of running your safari, the Operator reserves the right to impose any such surcharges on the Client as long as the total surcharge does not exceed 5% of the safari price. Should the surcharge be greater than 5%, the Operator will inform the Client and the Client may either pay the extra cost or cancel the trip within 7 days of notification and be entitled to a full refund.

3. EXECUTION OF THE TOUR

3.1 Impact Adventure Travel provides transportation, accommodation, meals, game drives and other services in cooperation with independent suppliers such as hotels, wildlife parks etc. Multi-country tours are also offered in cooperation with other operators. Impact Adventure Travel will make every effort to ensure that all safari arrangements run as smoothly as possible and all services are offered in the most efficient way possible. However, the Operator does not have direct control over the provision of services by independent suppliers and, whilst every supplier is chosen with utmost care, Impact Adventure Travel shall not be liable for errors or omissions of such suppliers.

3.2 Some camps and lodges offered in your itinerary may have limited capacity at peak times and as such the Operator cannot always guarantee availability. Reservations will only be made upon receipt of your booking and deposit. Should there be no availability at the time of booking your trip, the Operator reserves the right to offer alternative accommodation of equivalent standard or the next best quality accommodation, or suggest a superior standard accommodation which may attract an extra cost.

3.3 A suitable tour guide will be provided depending on the nature of your trip. The guide’s task is to ensure that your trip runs as smoothly as possible and that the quality of the safari experience meets your expectations. The Client agrees to cooperate with and respect the authority of the guide during the course of the trip.

4. ACCEPTANCE OF RISKS

4.1 Although Impact Adventure Travel has taken reasonable steps to provide the Client with information, equipment and skilled guides, the Operator informs the Client that their (Operator) activities are not without risk. Some risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be causes of loss or damage to your property, accidental injury or illness; or in extreme cases, permanent trauma or death. The Client should also understand that the description of these risks is not complete and that other unknown or unanticipated risks may result in injury or even death. The Client’s participation in this activity is purely voluntary and he or she elects to participate in spite of and with full knowledge of the inherent risks. The Client thus agrees to assume and accept full responsibility for the risks involved.

4.2 The Operator will not be liable for any consequences resulting from strikes, industrial action, wars, civil strife, terrorist activity, adverse weather conditions, natural disasters and other untoward occurrences or any uninsured losses of your property.

5. INSURANCE

5.1 The Client must have fully comprehensive travel insurance including medical cover. It’s also highly advisable you include cover for potential losses due to cancellation of the safari, curtailment and loss of personal property. A copy of the travel and health insurance details must be deposited with our office before your departure.

6. WILD ANIMALS

6.1 It is a privilege to see wild animals in their natural habitat and as such, the Operator cannot guarantee wildlife viewing. You must respect the privacy of wild animals in their natural habitat and carefully follow instructions given by your guide or park ranger. Do not exert undue pressure on the guide to criss-cross the landscape in search of favoured animal species as this may lead to violation of conservation laws.

7. CANCELLATION AND REFUNDS

7.1 Request for cancellation of your trip must be made in writing and shall be effective on the date of actual receipt by the Operator.

7.2 As the Operator may incur considerable costs if you cancel your trip, the Operator will retain your deposit to offset such costs and may impose the following cancellation charges to the basic program rate:

  • 42 days to 31 days prior to departure: 50% charge
  • 30 days to 16 days prior to departure: 80% charge
  • 15 days to 0 days prior to departure or No-Show: 100% charge

7.3 Whilst every reasonable effort will be made to adhere to the itinerary, the Operator reserves the right to cancel any tour or the remainder thereof or make any change in route, accommodation, price or other detail in the event of the tour being rendered impossible, illegal, or inadvisable by weather, strike, war, government interference or for any other reasons beyond our reasonable control (“force majeure”). The Operator will endeavour to provide an alternative experience of the same or similar value as the cancelled tour or part.

7.4 The guide or other Company representative reserves the right to cancel the holiday of any person(s) if they feel that the behaviour of that person(s) is causing annoyance, damage, distress or injury to other clients or a third party and the affected member will be asked to leave without recourse to any refund.

8. LIABILITY

8.1 The respective laws of the destination country govern Impact Adventure Travel’s liability to its clients. All claims are subject to the jurisdiction of the courts of the country in which the cause of action arises.

9. COMPLAINTS

9.1 If you are displeased with any of the services paid for, you should register your complaint immediately with the company representative and the supplier in question, who will do their best to resolve the matter.

9.2 In the event your problem is not solved to your satisfaction, the complaint should be reported in writing and not later than 10 days after completion of the tour. Liability for any complaints not notified in accordance with the above procedure will not be accepted.
